NGT refuses relief for resort over CRZ violation

The National Green Tribunal (NGT) has refused to stay or interfere into the March 2019 demolition order of the Goa Coastal Zone Management Authority on the Baywatch resort “for raising structure illegally in violation of the CRZ
notification.”

The bench comprising of Justices Adarsh Kumar Goel, Sudhir Agarwal, M Sathyanarayanan, Brijesh Sethi and expert member Dr Nagin Nanda dismissed the appeal of M/s Prudential Landmarks Pvt Ltd stating that “there is no error in the impugned order.”

“It is patent that the structures in question have been raised illegally in violation of the CRZ notification. The impugned order is based on adequate material and due process has been followed. No error has been shown in the impugned order. We, thus, do not find any ground to interfere with the impugned order,” the order reads.

The demolition order was based on the report of enquiry committee, which was constituted on High Court direction to act against all structures in NDZ areas, and so found this structure in violation of CRZ regulations.The enquiry committee during inspection found several concrete-made super structures, swimming pool and retaining wall in no development zone of Sernabatim village.
