Order in disqualification petition against 10 Ex-Congress MLA likely before March 8- Girish Chodankar

Digital Goa, Feb 26 – Speaker Rajesh Patnekar completed the hearing on disqualification petition filed by GPCC President Girish Chodankar against 10 defecting Ex-Congress MLAs today evening. “Finally the petition which was filed one and half year before the speaker came for final hearing today after Supreme Court compelled the speaker. Hearing has been completed and the matter is posted for final order,” informed Chodankar while speaking to media persons after the hearing. “ If SC would not have intervened, the matter would have continued till the elections were declared,” he lamented. Looking at the manner in which our counsel has argued the matter, we feel that the speaker is completely convinced that the merger is illegal, said Chodankar. “They tried to defend by producing some forged documents also,” he alleged further asserting that truth will prevail.
“Matter is listed on March 8 by SC so it is quite evident that speaker will abide by the Supreme Court directions and give the order before March 8,” he said. Earlier in the day, speaker heard the petition filed by MGP against 2 of its defecting Ex-MLAs.
“Speaker heard us a length. The 10 members have incurred disqualification under Tenth Schedule 10 of the constitution. We pointed out that the claim of the defected MLAs to say that there is a valid merger is not correct for the simple reason that under Para IV of the Tenth schedule original party should decide to merge and thereafter at least 2/3rd of the members should agree to such merger. In the present case 2/3 members have agreed but there is no decision absolutely of the original political party to merge. So that being not there, there is no question of valid merger in terms of para four,” informed the counsel.
“On 10 July 2019 they claim to have merged and become member of BJP, they have voluntarily given up the membership of their political party and hence they stand disqualified,” he added.
