The town  and country planning department and the village panchayat of Se-Old Goa have  derailed the controversial under-construction bungalow at the world heritage site, Old Goa, which has been facing  strong public outcry.

The TCP department has revoked the technical clearance granted on October 18, 2016 in the names of Jose Maria de Gouveia de Pinto and Maria Lizette de Abreu e Gouveia Pinto for repair/reconstruction of the house in survey number 4/1 of Ella village at Old Goa, where the  bungalow has been coming up.

S P Surlakar, deputy town planner of Tiswadi, issued a revocation order on Tuesday directing the applicant to immediately stop the construction activity in the property as permitted in the technical clearance order on October 18, 2016.

The order stated that an application was subsequently made by Suvarna Suraj Lotlikar alias Suvarna Dyanesh Dange to Tiswadi office for NOC for registration of sale deed (pre-sale) of the property bearing survey number 4/1 (part) of village Ella for an area admeasuring 2,400 sq mtrs and was considered.

And whereas another application was also made by Manish Vavratn Munot to the Tiswadi taluka office for issuance  of NOC for registration of sale deed of the remaining part of the same property – an area admeasuring 9,500 sq. mtrs – and was considered, it further said.

“It is quite evident that the relevant time of grant of NOC the property having an area of 2,400 sq. mts area was  under the ownership of Suvarna Lotlikar and remaining area admeasuring of 9,500 sq.  mtrs was under the ownership of Manish Munot and therefore  you are no  longer the owner of the property bearing survey number 4/1 at the time of grant of technical clearance on October 18, 2016,” said the  order issued to Pintos.

“Due to the fact the property under reference was already sold by you at the time of applying for technical clearance, it is quite clear that you could not have obtained the permission in your name and which implies that you have obtained the said permission fraudulently and misrepresentation of fact, thus attracting action as stipulated under condition number of 2 to the technical clearance issued on October 18, 2016,” it further added. The order said  the permission granted shall be revoked, if any information,

plan, calculations, documents and any other accompaniments of the  application are found incorrect or wrong at any state after the grant of permission and the applicant will not be entitled for any compensation.

The village panchayat of Se-Old Goa on Tuesday issued a ‘stop work’ order to the owner of the controversial  bungalow.

There has been public outcry against the illegal structure. A group of people have been holding ‘satyagraha’ at Old Goa, seeking demolition of the bungalow.

The notice said, “It has been unanimously resolved by the panchayat body based on legal opinion received from the advocate Sahish Mahambrey regarding revocation of licence issued for reconstruction of house in survey No 4/1 village Ella, based on the complaint of Vishal Volvoikar. As there is violation of (the) permission granted by CRZ (authorities) dated 28/12/2015 and the  permission  granted by the Archaeological Survey of India dated 03/02/2020, and accordingly the panchayat body has resolved to issue stop work order for construction activities in survey No   4/1 in  village Ella.”

“Therefore you are hereby directed to stop the said work immediately on receipt of this notice, failing which further necessary action will be initiated,” the notice said.

The notice has been  duly signed by  sarpanch of Se-Old Goa Janita Madkaikar, who told reporters  that  the project proponent has been given seven days to respond to the notice. 

The  notice said  the  ‘stop work’ order is being issued as per the resolution No 3(2) adopted by  the local body on Tuesday.

The  panchayat served show-cause notices to Jose Maria de Gouveia de Pinto and others,  H.No 541/7-A Lake View Colony, Miramar Panaji Goa; Suvarna Suraj Lotlikar, C/o Gopi Mhamal, Manasa Sarovar, 1st Level, near Govt Circuit House, Altinho, Panaji, Goa; and Sumermal Jain,  Corvus Urban Infrastructures LLP, Flat No 27, 4th Floor, Kranti Sadan, Shankar Pupala Road, Kamathipura, Mumbai Central, Mumbai, Maharashtra,  asking  them as to why the construction licence and the renewal licence should not be cancelled.

Madkaikar said the panchayat at a meeting also adopted a resolution to cancel the house number  issued to the structure in 2016 and the renewal licence issued in 2019.

The  local self-governing body  also asked: on what basis the licence was issued,  as  the property cannot be transferred, and when the ASI had given the licence only for repairs?

The  panchayat pasted the notice on a wall of  the  illegal structure with the help of police at  Old Goa.

AAP leader Amit Palekar, who has been on fast unto death seeking revocation of permissions to the structure, was on Tuesday visited by his wife and daughter.

Palekar, who  vowed to continue his fight to save the Old Goa  heritage, welcomed the decision of the village panchayat, adding  that they will study the TCP order, and  “till then my fast will continue”.
