Legal experts censure govt on Bhumiputra gamble

Panaji: Legal experts and former lawmakers have censured the referring of the controversial Goa Bhumiputra Adhikarini bill, 2021 to the law department, when the bill has already been passed in the state legislative assembly.

They said that something like this has happened for the first time in the history of the state legislative assembly; that a bill passed in the assembly has now been sent to the law department for examining. 

Former legislator and senior legal expert Uday Bhembre and former Union law minister and former MLA Ramakant Khalap stated that the BJP government made mockery of the Constitution by bringing in the faulty Bhumiputra bill.

And now the government has made itself a laughing stock by referring it to the law department for examining after the bill was passed in the state legislative assembly, they remarked. Bhembre maintained  that he has never seen such a badly-drafted bill in the history of the post-Liberation Goa.

“There is no clarity in the Goa Bhumiputra Adhikarini bill over several aspects. It is also clear that the said bill was not drafted by responsible officials of the government,” he said.

It never happened in the history of the state legislative assembly that a bill passed on the floor of the House was sent to the law department, Bhembre reckoned. 

The former Margao MLA also said the bill will not stand the scrutiny of court of law even if the word ‘Bhumiputra’ is deleted, as there is contradiction of objectives in the bill.

If the bill becomes law – even after deletion of the word ‘Bhumiputra’ – the enactment will be detrimental to the interest of Goa’s indigenous people, Bhembre observed.

The former Union law minister said, “We can clearly see that mind was not applied while drafting the bill. Moreover, it was not studied by legislators. The state government has committed a blunder by bringing in this bill.”

How a bill can be brought in to give protection to a person who encroached upon someone else’s property, and not giving right to protect his or her own property, which is a fundamental right?, asked the both the legal experts.

They said the government has sent a wrong message about the state  legislative assembly by passing the  bill without discussion.
